Painting contract.
This agreement is made this _________ day of
_________, 19__, between _________, called owner, and _________, called
contractor, all of _________, _________ county, _________.
1. Contractor agrees, for the consideration mentioned,
to furnish all labor and material and to completely finish all of the painting,
varnishing, tinting and staining which enters into the construction of the
_________ story and basement brick apartment building situated upon the
_________ corner of _________ street and _________ avenue in the city of
_________, _________.
2. Contractor agrees to furnish all equipment,
scaffolds, ladders, falls, canvas, clothes, etc., necessary for the completion
of this work without cost to owner, and to carry out and complete the work for
the consideration of _________ per hour for actual time spent overseeing and
directing the work, and _________ per day for the mechanics employed to execute
the work, and also the actual cost of the material purchased and used for the
painting, contractor furnishing vouchers and payrolls showing the actual cost
of this work. Contractor guaranteeing to completely finish all painting,
varnishing, tinting and staining in a thoroughly first-class workmanlike manner
under the direction and to the satisfaction of _________, architect, and
according to the requirements of the plans and specifications prepared by the
architect for the building, receiving the actual cost of material, _________
per day for the people employed, and _________ per hour for the actual time
spent overseeing the work as mentioned. Contractor guarantees and agrees that
the cost of the painting shall not exceed _________ dollars.
3. Owner agrees, in consideration of the conditions
and obligations mentioned being performed and carried out, to pay the
consideration mentioned in instalments as follows: As work progresses
sufficient money shall be advanced on each alternate _________ to pay the wages
of the people employed. Bills for material purchased after being OK'd as
correct by the contractor shall be delivered to owner who shall settle them directly
with the firms furnishing the material. The _________ per hour mentioned to be
paid contractor being retained until the completion of the work covered by this
contract when it also shall be paid to contractor, provided the total amount
paid does not exceed the guaranteed cost limit of _________ dollars.
4. In the event of additional work being performed by
contractor as a result of mutual agreement, the cost limit mentioned shall be
increased or decreased a reasonable amount by reason of the changes, owner
paying for additional work, if ordered, at the rates mentioned.
