Agreement between owner
and zoning administrator for noncomplying use.
This agreement is made on _________[date],
between _________, of _________[address], _________[city],
_________ County, _________[state], here referred to as owner, and
_________[name], the zoning administrator of the City of _________,
_________ County, _________[state], here referred to as administrator.
RECITALS
A. Owner is the owner of property at _________[location],
more particularly described as follows: _________[set forth legal
description].
B. Owner has applied for a building permit for the
construction of a major addition, as defined in _________[cite appropriate
section of city planning code], to owner's premises at the above address.
C. Administrator has determined that owner is required
by the city planning code and the regulations of the city planning commission
promulgated thereunder, and from information supplied to administrator by
owner, to provide _________[number] off-street parking spaces and _________[number]
loading spaces in connection with such major addition.
D. Administrator has examined the building plans for
the alteration and construction work to be done by owner and has examined and
approved plans for the use of an off-site parking lot and has examined a
_________-year lease for the rental of such off-site parking lot by owner and
the plans for parking spaces in such parking lot.
E. The off-site parking lot and the premises in their
present condition will provide the required off-street parking and loading
space for a period of _________ years and for the term expressed in the lease.
The parties agree as follows:
SECTION ONE.
PROVISION OF OFF-STREET PARKING SPACES
Owner will on or before the expiration of the lease
provide _________[number] off-street parking spaces and _________[number]
loading spaces in the area _________ 21_________[to the rear] of owner's
premises or in the basement thereof or elsewhere in a location conforming to
the provisions of the city planning code.
SECTION TWO.
PARTIES BOUND; COVENANT RUNNING WITH THE LAND

this agreement, and this agreement shall constitute a covenant running with the
land and shall be binding on any transferee from owner, in the event of a sale
or conveyance of the premises or any part hereof at a future date.
SECTION THREE.
CONDITIONAL APPROVAL OF APPLICATION FOR BUILDING
PERMIT
Administrator hereby approves the application for a
building permit made by owner on condition of the execution and recordation of
this agreement. Attached hereto and incorporated in this agreement by reference
is a duly verified copy of the above-mentioned lease between owner and
