Sale of ore.

This agreement made this _________ day of _________, _________[date], by and between _________ and _________, husband and wife, of _________, referred to as owners, and _________, of _________, referred to as agent:

Owners are the owners in fee simple of the following described real property located and situated in _________ county, _________ which property contains certain ore known as _________ ore.

Owners desire to give the exclusive right of selling and distributing _________ ore and to create an extensive agency covering the United States of America.

It is mutually agreed by and between the parties and in consideration of valuable considerations paid to owners by agent, receipt acknowledged, as follows:

1. Owners agree to give to agent the exclusive right and agency throughout the United States to sell and distribute _________ ore from the property described upon the terms and conditions provided.

2. Agent agrees to pay to owners _________ dollar per pound for _________ ore and _________ dollars per gallon for _________ liquid ore to contain specific gravity test of not less than _________. Owners are to furnish one _________ cent carton of _________ ore with each pound of _________ ore.

3. Owners are to prepare liquid _________ ore and deliver it upon the premises described and to furnish to agent any amount of liquid and mineral ore as they may require.

4. Agent shall purchase from owners not less than _________ dollars of the products on _________, _________[date], _________ dollars of which is paid upon the amount of _________ dollars for products to be hereafter delivered and said _________ dollars to be paid upon the terms and conditions provided and stipulated, and for a period of _________ months following _________ day of _________, _________[date], agent is to purchase not less than _________ dollars per month being the total sum of _________ dollars of products to be purchased by agent _________ months after _________, _________[date], all purchases to be paid for in cash before the purchases leave the premises, and agent for the second year of this contract agrees to purchase a greater amount of the products than the first year and each succeeding year to purchase a greater amount than the preceding year, it being intended that each succeeding year must show an increase in quantity purchased over the preceding year or this contract shall become null and void.

5. Owners at their own expense shall place the ore in pound boxes and crate them, and for all liquid ore prepared the containers shall be paid for by agent.

6. Owners shall have the right to sell to individual consumers _________ ore in pound packages not to exceed the sum of _________ dollars per month at the rate of _________ dollars per pound and any amount sold over and above shall belong to owners and agent jointly.

7. Owners shall have the exclusive right to continue to maintain, operate and conduct their baths upon the premises. Agent has no right to give _________ or baths.

8. This contract shall be considered as a lease upon all the _________ ore upon the premises described and to run with the land and to be a part of the real property and owners shall not encumber the premises so as to interfere with the right of agent in selling and distributing the ore and in the event any liens or encumbrances are upon the premises and not paid for by owners, the agent may pay it and deduct the amount paid from the purchase price of the ore purchased from owners.

9. This contract and agreement shall continue so long as any of the ore remains upon the premises and so long as agent fulfills the terms and conditions of this agreement.
