GENERAL RENTAL AGREEMENT

 

 

THIS AGREEMENT is made on ___________________________ (Date) between _________________________________________________________________, hereinafter called Owner, and _________________­­­__________________, hereinafter called Renter.

 

PROPERTY DESCRIPTION

______________________________________________________________________

The Owner warrants that to the best of his/her knowledge and belief the aforesaid property is free of faults or deficiencies which would affect its safe and dependable operation under normal and prudent usage.

 

RENTAL PERIOD

The Owner agrees to rent the above-described property to the Renter for a period of _______________________ (Time Period), beginning _______________________ (Date) and ending _____________________ (Date).

 

USE OF PROPERTY

The Renter further agrees that the rented property shall [1] not be used beyond any rated capacity; [2] shall not be used for any  illegal purpose; [3] shall not be used in any manner for which it was not designed, built, or designated by the manufacturer; [4] will not be used in a negligent manner;  and [5] will not be operated by any other person without the written permission of the Owner.

 

 

INSURANCE

The Renter hereby agrees that he/she shall fully indemnify the Owner for any and all damage to or loss of the rented property and any accessories or related equipment during the term of this Agreement whether caused by fire, theft, flood, vandalism, or any other cause, except that which shall be determined to have been caused by a fault or deficiency of the rented property, accessories, or equipment.

 

RENTAL RATE

The Renter hereby agrees to pay the Owner at the rate of $ ________________ per _______________ (Daily/Weekly/Monthly) for the use of said property and any accessories/equipment.  Any fuel used shall be paid for by the Renter. 

 

DEPOSIT

The Renter further agrees to make a deposit of $ _________________ (Amount) with the Owner.  Said deposit to be used, in the event of loss of or damage to the rented property and any accessories/equipment during the term of this Agreement, to defray fully or partially the cost of necessary repairs or replacement.  In the absence of any damage or loss, said deposit shall be credited toward payment of the rental fee and any excess shall be returned to the Renter.

 

RETURN OF PROPERTY TO OWNER

The Renter hereby agrees to return the rented property and any accessories/equipment to the Owner at __________________ (Location) no later than __________________ (Date).

 

TERMINATION OF AGREEMENT

It is mutually agreed that the Renter shall have the right to terminate this Agreement at any time by payment of one full days rental for each 24-hour period or any part thereof, during which the Renter has retained possession of the property and any accessories/ equipment during the term of this Agreement.

 

IN WITNESS WHEREOF, the parties hereto hereby execute this Agreement.

"With something as important as a rental agreement, you always need to make sure you have covered al the issues. The first and most important is to define exactly what the rental unit is and how it can be used during the term. So you should combine a brief description in the agreement itself with a schedule describing the state of the unit's repair, and a list of all the contents let for use. Setting the mutual duties for maintenance and repair is also useful to avoid future disputes. And linking the state of the property on termination to the return of the security deposit is necessary. One other thing worth thinking about is whether to build in the right to claim a lien if the rent is unpaid. That gives the landlord the right to seize and, if necessary, sell the renter’s property to recover unpaid rent. If in doubt, get expert help to customize the agreement."

"My dad died a while back and I decided to rent out our old family home rather than leave it standing empty. I needed a rental agreement. Free is a bonus. Except that I was worried when I read it and ended up paying for it to be customized by the contributor. It didn’t cost a whole lot but it was more hassle than I expected. A couple of examples. I love our old home and wanted to make sure it was properly insured by the renter. That meant a right to see the policy and the right to terminate the agreement if I found out the policy lapsed. And the security deposit. If the renter insured, the renter would pay for the repairs out of the policy. I wanted to keep the deposit in case the renter left the home in a poor state and I had work to do to make it good again. The final agreement I ended up with doesn’t look much like this which is a good thing because I got what I wanted and it probably cost me less than going to an attorney picked from Yellow Pages. "
