Reconveyance by trustee
where all debts have been paid.
This reconveyance made on _________[date],
between _________ of _________, called trustee, and _________ of _________,
called debtor, agree as follows:
By an assignment made on _________[date],
between debtor and trustee, all the real property conveyed and assigned was,
together with other property, conveyed to trustee on the trust declared in the
assignment, and it was provided that debtor should pay or otherwise satisfy all
debts, expenses, costs and charges secured by or payable under the assignment,
and should fully indemnify trustee in respect of all debts and liabilities
incurred by him [her] under the deed of assignment in connection with his [her]
dealings with the property subject to the trust, and that debtor should
immediately be entitled to require trustee to reconvey and reassign to him
[her] all or so much or such part or parts of the trust property as should
remain unconverted.
All debts, expenses, costs, and charges secured by or
payable under or by virtue of the assignment have been paid and fully
satisfied, as appears by the accounts of trustee showing all the particulars of
his [her] receipts and disbursements in relation to or under the assignment and
the property subject to the assignment and as appears by the receipts of the
creditors of debtor, all of which receipts have been examined and approved by
debtor as he acknowledges, and all the debts, expenses, costs,
and charges have been paid and satisfied without any sale of the property
conveyed, as acknowledged and declared by trustee.
Debtor has requested trustee to reconvey the real
property described free and discharged from the trust of assignment and debtor
has agreed to discharge, release, and indemnify trustee in the following
manner.
This deed provides as follows:
In consideration of the premises and in pursuance of
the provisions of the assignment, trustee conveys to debtor all that property
more particularly described in the schedule attached to this document, to hold
in fee simple, and trustee, as such, assigns, surrenders, and releases to
debtor all the property referred to in the schedule to hold in fee simple.
Debtor releases and agrees to keep indemnified
trustee, his [her] executors and administrators, and his [her] estate and
effects, from and against all claims, demands, actions, proceedings, costs,
damages, and expenses, which may or might be made or arise in relation to the
trust properties, or any part of the trust properties, or trustee's dealings
with the trust properties, or any other thing done or omitted to be done by
trustee under the assignment or otherwise in relation to the premises.
