On roof.
Lessor agrees that lessee shall have same right to
construct an electric sign standard on roof of building that lessor would have
had if this lease had not been executed, without payment to lessor of any
additional compensation whatever, and that no such right shall be granted to
any other tenant or lessee of building or any part thereof, or to any other
person whatever, such right of lessee to be subject, however, to the following
terms and conditions:
(a). Lessee will, at its own cost and expense, obtain
any and all permits and licenses required from time to time by city of
_________, and all departments of city, or other governmental authority, for
construction and maintenance of such standard.
(b). All ordinances, rules and regulations of city of
_________, and all departments of city or other governmental authority, and all
requirements of _________ board of underwriters of _________ with reference to
the construction and maintenance thereof, shall at all times be fully and
promptly complied with.
(c). Cost of erection and operation thereof shall be
paid by lessee.
(d). Any such standard shall be at all times kept and
maintained in good order, repair and condition by lessee at its own cost and
expense.
(e). Such standard shall be constructed and maintained
at sole risk of lessee, and lessee agrees to pay any and all damages to persons
as well as to property that may in any way or manner be caused by construction
or maintaining or operation of any such standard; and lessee agrees to
indemnify and hold lessor free and harmless from any and all loss, cost,
expense (including attorneys' fees) and damages to which lessor may be put or
occasioned by reason of construction, maintenance or operation of any such
standard or by reason of any advertisement or other matter displayed thereon.
(f). No advertising or other matter shall be displayed
on or about such standard, except such matter as shall advertise business of
lessee, and at no time shall any advertisement or other matter be displayed in,
on or about any such standard without such advertisement or other matter being first
approved in writing by lessor.
(g). Lessee agrees not to erect or cause or permit to
be erected any such standard until plans and specifications therefor, the
manner and method of its construction and location of same, shall have been
approved in writing by lessor.
(h). If sign standard is not kept and maintained in
good order and repair by lessee, lessor shall have right (but shall not be
required) to maintain same, and lessee shall pay lessor all costs and expenses
of such maintenance whenever any such costs or expenses are incurred; and
lessor shall also have the right in such event to remove and store such sign
standard if lessor shall so elect, all at risk of lessee, and cost and expense
of such removal and storing and also cost of repairing any damage done to
building by erection or maintenance or operation of standard shall be paid by
lessee; and if lessee shall not keep and maintain standard in good order and
repair, lessee shall have no further right to keep or maintain any standard on
roof of building but all rights thereto shall revert and belong to lessor; and
lessor shall have right at all times, without notice to lessee, to remove any
and all advertisements and other matter at any time or times placed or
displayed on standard to which lessor has not in writing consented, and the
cost of such removal shall be paid by lessee; and on termination or expiration
of this lease, by lapse of time or otherwise, or on termination in any manner
of right of lessee to maintain a standard on roof, any standard at such time
thereon and all paraphernalia connected therewith, shall be and become sole
property of lessor, without payment of any consideration therefor by lessor.
Lessor shall likewise have the right to maintain a
standard on roof displaying name of building.
No part of roof, or right to maintain a standard
thereon, is demised by this lease.
